Estate Planning – Will & Trusts

Robinson | Bailey PC provides full service estate planning to our clients. Our plans are not a one-size fits-all but are tailored to our client’s specific needs. We provide our clients with estate plans that are comprehensive, understandable and flexible in light of the ever-changing landscape of estate and tax law.

Your estate plan begins with a consultation with one of our attorneys, where we will discuss your unique circumstances and model a plan that best meets your needs. We will prepare all the necessary estate planning documents, including:

Wills

Trusts

Financial (General) Durable Powers of Attorney

Medical Durable Powers of Attorney

Living Wills/Declarations as to Medical or Surgical Treatment

HIPAA Authorization Forms

Personal Property Memoranda

Declaration of Disposition of Last Remains (upon request)

Additionally, we provide post-planning services, including re-titling of assets, recording of deeds, assistance with changing beneficiary designations, pre- and post-nuptial agreements and cohabitation agreements, and other advice as needed.

Estate plans range from simple wills to plans which include trusts to minimize estate taxes or protect beneficiaries. Our plans may also include the formation of small business entities, such as family limited partnerships or limited liability companies to facilitate wealth protection and transfer, life insurance trusts, charitable trusts, or other trusts designed to shift wealth to the client’s beneficiaries. For clients with a taxable estate, a gifting plan may be considered. All plans take into consideration the estate taxes to which the client may be subject.

A trust is an agreement created by a grantor/settlor for the management and protection of assets for one or more beneficiaries. Trusts are important for protecting the assets of minor children and have other tax and estate planning benefits. At Robinson | Bailey PC, we assist clients in establishing trusts, re-titling assets as necessary, and understanding the trust requirements in order to achieve the results they expect.
